Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of the website at varno.fitand the Varno size-recommendation service (collectively, the “Service”), operated by Varno (“Varno”, “we”, “us”). By using the Service or by creating an account, you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

The Service is intended for use by businesses and by adult customers (18 years or older). By using the Service, you represent that you have the legal authority to enter into these Terms on your behalf or on behalf of the brand you represent.

3. The service

Varno provides an AI-assisted size-recommendation widget and related analytics for fashion brands. Recommendations are produced by algorithms and are advisory in nature — actual fit depends on many factors, including individual body shape, product construction and personal preference. Varno does not guarantee that a specific recommendation will result in a preferred fit or in any particular reduction in returns.

4. Trial and subscriptions

Where a free trial is offered, the trial period and any conversion to a paid plan will be described at sign-up. Unless otherwise stated in writing, paid subscriptions renew on the stated billing cycle until cancelled. You can cancel by writing to hello@varno.fit. Fees already paid for the current billing period are generally non-refundable, except where required by law.

5. Acceptable use

You agree not to:

  • Use the Service in any unlawful manner or in violation of any applicable law or regulation;
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service;
  • Attempt to interfere with, overload, or disrupt the Service or its infrastructure;
  • Use the Service to infringe the intellectual property or privacy rights of others;
  • Resell, sublicense or otherwise commercially exploit the Service without our prior written consent.

6. Intellectual property

The Service, including all software, designs, logos, content and data, is owned by Varno or its licensors and is protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose, subject to these Terms.

Third-party brand names referenced in the Service are the trademarks of their respective owners and are used only for descriptive or comparative purposes. Their use does not imply any affiliation, endorsement or sponsorship.

7. Customer data and privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Varno disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Any figures shown on varno.fit (including return-reduction, savings, ROI or accuracy figures) are illustrative estimates and do not constitute a guarantee of results.

9. Limitation of liability

To the maximum extent permitted by law, Varno will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, goodwill or data, arising out of or in connection with your use of the Service. Varno's total aggregate liability under these Terms will not exceed the fees you paid to Varno in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold Varno harmless from any third -party claim arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a manner that we reasonably believe may cause harm to Varno, its users or any third party. You may stop using the Service at any time.

12. Changes to these terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Service after such changes constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts located in India.
